Booking Conditions

Your contract is with easyCruise (UK) Ltd trading as easyCruise.com. These are the terms and conditions of your contract with easyCruise.com. Please read them carefully as you will be bound by them.

1. DEFINITIONS In these Booking Conditions: “we” or “us” means easyCruise.com (including, where appropriate, our employees, agents, and suppliers and all relevant insurers); “you” or “the passenger(s)” means any and all person(s) for whom a cruise is booked and named in the confirmation; “supplier(s)” means any person (including employees, agents, independent contractors and sub-contractors and all relevant insurers) who provides any service covered by the price for the cruise; “concessionaire” means any person (including employees, agents. independent contractors and sub contractors and all relevant insurers) who provides on-board services; “the Contract” means your contract with us for a cruise; “the cruise” means the cruise booked with us as advertised at www.easyCruise.com or elsewhere, but not including on-board services and excursions; “the price” means the price for the cruise; “on-board services” means all services and facilities (including catering) which are available on board the cruise ship for separate purchase from our concessionaires and which are not provided as part of the Contract; “excursion” means any excursion available for purchase on board the cruise vessel from a concessionaire or any other independent excursion operator.

2. When you make a booking, you confirm that you and every other person in your party (and their personal representatives) agree to be bound by these Conditions and any other term of the Contract and that you have full authority to do so.

3. HOW TO BOOKBookings may be made online at www.easyCruise.com or by calling: from the UK: 0871 210 0001 (10p per minute.), from the USA and Canada: 866 335 4975 (toll free), from all other countries: +30 211 211 6211. You can also visit our office at 362, Syngrou Avenue, 176 74 Kallithea, Athens, Greece. Alternatively you can contact your travel agent. When you first book with us, you will be registered as a customer of easyCruise.com and you will be required to provide details of a credit or debit card which will form part of your registration. We will open an account in your name and all payments for bookings made by you will be shown as debits to your account. For future bookings, you may either use the registered credit or debit card or another card. For all bookings, you will also be required to provide your passport details before the departure of your cruise and those of all others travelling with you.  You assume full responsibility for the accuracy of information you have provided during any booking.

4. CHILDREN we welcome families with children, however at the same time we acknowledge that our ships do not have special facilities for children. Therefore we strongly recommend that families with children under the age of 12 years old at the time of travel carefully read the following information and then make an informed decision if this is the right type of holiday for them. Moreover the holidays we offer, feature itineraries designed to provide as much time in each destination as possible, so you need to decide if the destinations on your chosen cruise are suitable for your family. The easyCruise Life ship offers cabin accommodation for up to four people sharing in a QUAD with WINDOW. In SUPERIOR DOUBLES and PANORAMIC SUITES there is a double sofa bed which can be used by up to 2 children. In addition the PANORAMIC SUITES can accommodate a third child on a rollaway bed. On the easyCruiseOne ship, SUPERIOR DOUBLES and SUITES with BALCONY have a double sofa bed which can be used by up to 2 children. If you are travelling with an infant under 2 years old, you must book a SUPERIOR DOUBLE or SUITE which will have enough space for a cot to be provided by easyCruise.com.
Children aged 12 and under must share a cabin with at least one close family member who is over the age of 18. Children aged 13-17 must travel with at least one adult over the age of 18. In the latter case, upon boarding, a child between 13-17 shall provide the original written consent of his parents (click here to download the relevant form) certified by an appropriate public authority which shall include the (adult) co-passenger with whom the child will be travelling. Onboard our ships there are no playrooms or special children’s facilities. Shore excursions are generally not suitable for pre-teens and you should take this into account when planning your holiday. easyCruise.com does not provide any childcare facilities so children must be adequately supervised at all times by their parents and children must never be left in the cabin, anywhere in the ship or ashore unsupervised.

5. PRICES All prices are displayed per cabin and not per person. Most cabins are for 1 or 2 persons with a limited number for 3 or 4 persons. Persons travelling alone pay the per cabin price. All bookings are subject to cabin availability. The prices vary according to demand and they generally rise as the ship fills up so to get the best price book early. We reserve the right to vary our prices from time to time. If prices do vary they will apply to new bookings only from the date of variation and any increase or decrease in price will not be applied retrospectively. The correct prices will be displayed at the time of booking. Online prices include accommodation with half board meal plan and daily housekeeping. Port fees and fuel supplement are not included in the price and are stated separately. Additional meals, drinks, spa treatments, tours and other services can be purchased onboard. Some optional extras can be booked and paid for at the time of booking your cruise. You will need to make your own travel arrangements to get to and from the ship.

6. PAYMENT Full payment for the cruise must be made at the time of booking. Payment for all bookings made online and by telephone must be made by credit or debit card - we accept Visa and MasterCard but not American Express. Payment in cash can be made by visiting our office at 362, Syngrou Avenue, 176 74 Kallithea, Athens, Greece. Payment to a travel agent may be made in any form accepted by the travel agent and will be deemed to be payment to easyCruise.com. Once a booking has been completed, a confirmation will be issued which you should print when booking online. For telephone bookings, a confirmation will be sent to you either by email or by post. Travel agents will give you a confirmation at the time of booking. No tickets will be issued. Please ensure that you have the confirmation with you when you join the cruise.

7. PRICE INCLUDES The cruise price includes the cruise as described in your chosen itinerary; accommodation with half board meal plan, daily housekeeping and the use of general facilities like the hot tub and sun beds. Port fees and fuel supplement are not included in the price and are stated separately. The price does not include additional meals, drinks, spa treatments, tours, additional housekeeping services and cost of any other on-board service, all of which are available for separate purchase entirely at your choice. All on-board services and excursions are priced in € Euros. For your convenience while you are onboard, any charges for purchases and services will be added to your personal onboard credit account. Your account must be settled in full before you leave the ship at the end of your cruise. At check-in you will be asked how you wish to settle the account for your onboard charges - there are two options.

Credit Card (Visa or MasterCard)
For each cabin the credit card holder will be preauthorized for the amount of 30 Euros per day. This means that your bank will put a “hold” on this amount during your stay. At the end of the cruise the balance due will be charged to your credit card, and any excess funds “on hold” will be released. Please note that if you have any intention of using a credit card to pay for your charges onboard then it must be submitted for pre-authorization on the first day of your cruise.

Cash Deposit
For each cabin you can leave a cash deposit that will be applied to your on board account. Once your charges have reached the cash deposited amount then you will be required to provide us with further deposit. The recommended amount is 30 Euros per cabin per day.

8. NOT INCLUDED The price does not include your travel to and from the ports where you join and leave the cruise ship and you are solely responsible for such travel arrangements.

9. CHECK IN The check-in time varies and will be detailed on your confirmation. It will be your responsibility to ensure that you arrive in good time to join the ship and we cannot be held liable for the consequences of you failing to do so. At the end of your cruise, you must vacate your cabin by the time published onboard and you will generally be allowed to disembark approximately an hour after arrival.

10. EMBARKATION CHANGES Please note that on certain dates and due to local events, the cruise ship will be unable to use the usual berth within a port. On these dates, embarkation and disembarkation will be by tender to and from the cruise ship at anchorage, unless an alternative berth is available at the port. Full details will be posted and available at the earliest possible opportunity onboard or on our web site at www.easyCruise.com. Please note that if you book to join a cruise on any such date, it will be your sole responsibility to ensure that you arrive at the correct place of embarkation within the time for check-in. Furthermore, berthing and embarkation arrangements at any port may be subject to change at short notice for reasons entirely outside our control and you should always check this at our website or by calling in good time before your departure: UK: 0871 210 0001 (10p per minute), USA & Canada: 866 335 4975 (toll free) and International: +30 211 211 6211. In no circumstances will we have any liability for any consequences of you failing to board the cruise ship as a result of any change in the embarkation arrangements where the details have been made available in advance.

11. PREGNANT WOMEN Our ships have only limited medical facilities on board. We cannot therefore accept bookings from or on behalf of anyone who is 28 weeks or more pregnant and anyone who books a cruise when pregnant does so entirely at her own risk. We reserve the right to refuse boarding permission to any passengers who appears to be in an advanced state of pregnancy.

12. SAFETY We must be satisfied that you are fit to travel on the cruise ship without risk to your own health and safety and/or that of any other person on board the ship and we reserve the right to ask you for medical evidence of this. We will not be liable in any circumstances where we have to refuse permission to join the cruise ship for this reason.

13. DISABLED GUESTS The easyCruiseOne ship has only one cabin with window suitable for disabled passengers, the easyCruise Life ship has two standard cabins with window suitable for disabled passengers. Furthermore, at certain locations, the cruise ship may not enter the port and embarkation and disembarkation is by tender to and from the ship at anchorage, and any disabled passenger (whether wheelchair-bound or not) is advised to consider avoiding these ports. Wheelchairs carried on board the cruise ship are for emergency use only. Passengers using wheelchairs must provide their own standard size wheelchair and must be accompanied by another passenger fit and able to assist them. Details of any disabled passenger must be provided when booking and we must reserve the right to reserve passage to anyone who appears unfit to travel or whose condition may represent a danger to themselves or to other persons on board.

14. CANCELLATION Once you have made a booking and paid in full this amount is non-refundable. We will open an easyCruise account in your name which will show credits for payments you have made and debits for bookings and other charges. If you wish to cancel your booking after it has been made, you must complete the cancellation process as soon as possible. At the time of cancellation your online easyCruise account will be credited with the amount you have already paid less the cancellation charge detailed below. Any remaining balance will be held in your online easyCruise account and can be used as payment towards a future cruise within a period of 12 months from cancellation date.

Special conditions will be applied for group cancellations.

15. CHANGES If after you have made your booking you wish to transfer the booking to another person (who must satisfy the requirements of these Conditions), or change any of the names, there will be an administration charge of £10 or €15 which we will charge to your registered debit or credit card. If you decide to change the date this will be treated as a cancellation as detailed above and a new booking will be made. Please note that you should cancel the original booking before making your new booking.

16. EXCURSIONS These are available for purchase on board the cruise ship or as part of a pre-purchased optional extras package. Excursions are arranged by independent operators, and who may themselves employ local agents. Excursions do not form part of the cruise and accordingly we cannot have any responsibility or liability for their performance.

17. INSURANCE We strongly recommend that you have adequate travel insurance in place to cover you against any medical expenses in the event of illness or injury and against any possibility of your cruise having to be cancelled for reasons outside our control.

18. CANCELLATIONS AND CHANGES BY US In the interests of security, we reserve the right to cancel your reservation in the event that you fail to provide full names for every person travelling. Such cancellation will result in the charges detailed in section 14 and you will be informed in advance by e-mail or by phone using the contact details in your account. We will obviously do our best never to cancel a cruise or to change the itinerary. Nevertheless, we must reserve the right to do so where it is necessary on operational or safety grounds or where this is the result of something entirely unforeseeable and outside our control such as (but not exclusively) war or threat or war, terrorist activity or the threat of this, riots or other civil disorder, any natural or nuclear disaster, fire, port closure, act of any government organisation, any industrial action, medical emergency at sea, lawful deviation at sea in response to a distress call or other emergency, and adverse weather conditions. The Master of the cruise ship is at all times solely responsible for the safety of the ship, the crew and all other persons on board and any decision reasonably taken by him shall not give rise to any liability of him or us.

19. CURTAILMENT In the unlikely event of us having to cancel or cut short or abandon a cruise for any other reason, we will credit your account with the price you have paid (either in full or on a pro rata basis, whichever is appropriate) without deduction of any administration charge and you will be entitled to book another cruise with us. Depending upon the circumstances in which the cancellation or other change arises, we may also pay you compensation up to but not exceeding the price you have paid.

20. CONDUCT ON BOARD We expect you at all times during the cruise to conduct yourself properly and with due regard to the health, safety, comfort, enjoyment and general wellbeing of everyone on board the cruise ship. The Master will be entitled to have removed from the ship at any time and at any place any passenger whose conduct or behaviour breaches this requirement and we shall have no liability in respect of such removal and any consequences.

21. SECURITY For security reasons, it may be necessary at any time to search passengers and/or their luggage and goods. By making the booking, you agree to allow such search upon request by the Master or any other authorised person.

22. LIABILITY We will be responsible at all times for the proper performance of the cruise, including that of suppliers. We will not, however, be liable for any failure or improper performance which is caused by the fault of the passenger, or by the unforeseeable or unavoidable act or omission of any person unconnected with the Contract (including our concessionaires), or by unusual and unforeseeable circumstances beyond our control where the consequences could not have been avoided even with all due care, or by any event which could not have been foreseen or avoided even with all due care (including but not limited to the events described in clause 18 above). In no circumstances will we be liable for the performance of excursions.

23. ATHENS CONVENTION Carriage of passengers and their luggage by sea is governed by the Athens Convention 1974 (whether as amended or otherwise - “the Athens Convention”), a copy of which is available on request. The Athens Convention is expressly incorporated into these Conditions and any liability we may have for death, personal injury or loss of or damage to luggage shall be determined accordingly. In most cases the Athens Convention will limit such liability and makes special provision for valuables. It presumes that we have delivered your luggage undamaged unless you give us written notice to the contrary.

24. LAW AND JURISDICTION Your contract with us is governed by English law. By making a booking with us, you agree that any claim which you may wish to bring against us or which we may wish to bring against you will be subject to the exclusive jurisdiction of the English courts. Any claim against us (whether or not governed by the Athens Convention in accordance with clause 23 above) must be notified to us in writing within 28 days of disembarkation and any legal proceedings against us must be brought within two years of the date of the incident giving rise to the claim, failing which any such claim will be time barred and we shall have no liability to you.

25. PSA ARBITRATION Some claims up to a limited amount may, if you so wish be referred to arbitration under a scheme operated by the Passenger Shipping Association (“PSA”), for which an application must be made within nine months of disembarkation. The PSA also offers a low cost conciliation procedure which involves a non-binding review of correspondence by an independent conciliator. Details are available on request.

26. CONSUMER PROTECTION Our cruises sold in the UK are protected under the PSA Consumer Protection Scheme. In the unlikely event of our insolvency, the PSA will ensure that you are not stranded abroad and will arrange to refund the money you have paid to easyCruise.com. The loss and expense which you may incur for other travel arrangements will need to be covered by your travel insurance.

27. DATA PROTECTION We will retain all personal information which you provide. We may need to pass this information on to other persons such as our concessionaires, travel agents, airlines, hotels and transport companies, and it may also be provided to security and/or credit checking companies, credit and debit card companies, government and enforcement agencies, public authorities such as customs and immigration if so required, or as required by law. This may involve sending your personal information between different countries, including countries outside the European Economic Area where controls on data protection may not be as strong as the legal requirements in the UK.

28. FOOD & ALCOHOL ONBOARD In the interests of public health and safety, easyCruise does not permit the consumption of any food or alcohol on board which you have purchased or acquired ashore.
